FEES FOR EXTENDING THE !!!!P 2, C0!!STRUCTION PER' TIT (CP) t Thanks for a copy of your November 3,1978 flote to Steven A. Varga l
confirming our recent telephone conversation on the above subject.
There are two items that need correction and that is the purpose of this note l
to you.
1.
The effective date of the revided rule that requires fees for CP and operation license amendments aGd other approvt.ls was !1 arch 23,1978 l
in lieu of !! arch 29, and 2.
The type of action and review Seing requested by a licensee deternines i
the appropriate fee class and 9. not the deciding factor as to whether the request is subject to fees.
Therefore, the point I was making about changing scope was that the only times an application received prior to !! arch 23, 1.978, requires a fee are:

(a) If the licensee (on or after flarch 23,1978) resubmitted the o original application or supplemented it in a manner that the scope (what is being requestcJ) is changed from that set forth 3
in the' original request, and (b) If the original application which preceded l' arch 23, 1978 was not comolete cd acceptable and was resubmitted on or after l
March 23, 1978.
r Since the ItiP-2 extension application was dated December 28, 1976, and was not resuFnitted or supplemented in the manner set forth in (a) or (b) above, no fee was necessary.
