CERTIFICATE OF COMPLIANCE NO. 9295, REVISION NO. 7, FOR THE MODEL NO. MIXED OXIDE FRESH FUEL PACKAGE (MFFP) PACKAGE

Dear Mr. Noss:

As requested by your application dated July 15, 2020 (Agencywide Documents Access and Management System [ML20198M683]), enclosed is Certificate of Compliance No. 9295, Revision No. 7, for the Model No. Mixed Oxide Fresh Fuel Package (MFFP) package. Changes made to the enclosed certificate are indicated by vertical lines in the margin. The staffs safety evaluation report is also enclosed.

The approval constitutes authority to use the package for shipment of radioactive material and for the package to be shipped in accordance with the provisions of Title 49 of the Code of Federal Regulations (49 CFR) 173.471. Those on the attached list have been registered as users of the package under the general license provisions of 10 CFR 71.17 or 49 CFR 173.471.

Certificate of Compliance No. 9295 Revision No. 7 EVALUATION By letter dated July 15, 2020 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML20198M683), Orano Federal Services LLC., (Orano), requested renewal of Certificate of Compliance No. 9295 for the Model No. Mixed Oxide Fresh Fuel Package (MFFP) transportation package. Orano did not request any changes to the package design, operating procedures, or acceptance tests and maintenance program.

The U.S. Nuclear Regulatory Commission (NRC) reviewed the documents in ADAMS that are referenced in the certificate of compliance to ensure the NRC record is complete and accurate.

NRC noticed that the May 24, 2010 (ADAMS Accession No. ML101590542) submittal was a consolidated application, however the NRC did not list it as such in section 3.b or the references section of the certificate of compliance. NRC reviewed the March 24th submittal and notes, that as of that date, it was a complete consolidated application, accordingly, NRC has revised section 3.b and the references section of the certificate.

NRC clarified the certificate to revise OD to be outer diameter.

These changes do not affect the ability of the package to meet the requirements of Title 10 of the Code of Federal Regulations Part 71.

CONDITIONS Item 3.b was revised to list the AREVA Federal Services May 24, 2010 consolidated application.

Condition 9 was revised to reflect the new expiration date of August 31, 2025.

The references section has been updated to include the May 24, 2010 consolidated application, include the submittal for this renewal as a supplement, and clarify which certificate holder submitted the application and each supplement.

CONCLUSION Based on the statements contained in the application, and the conditions listed above, the staff concludes that the changes indicated do not affect the ability of the package to meet the requirements of 10 CFR Part 71.
