HUMPHREY FOR PERMISSION TO PARTICIPATE AS A STATE REPRESENTATIVE IN THE ATOMIC SAFETY AND LICENSING BOARD PROCEEDING PURSUANT TO 10 C.F.R. 2.715(c)
By Petition filed on January 8, 1987, U.S. Senator Gordon J.
Humphrey petitioned the Board for permission to participate in this proceeding as a " state representative" pursuant to 10 C.F.R. Section 2.715(c).
That procedural provision permits persons not a party to a licensing proceeding under 10 C.F.R. Section 2.714 to participate in many respects in such a proceeding.
This option is available to
" representatives of an interested State, county, municipality, and/or agencies thereof".

As the undersigned counsel has advised Senator Humphrey's staff, the New Hampshire Attorney General's Office is participating in this proceeding as the State's sole representative.

h 2-Request for Hearing by the State of New Hampshire and Gregory H.
Smith, the Attorney General of the State of New Hampshire, dated November 11, 1981.
The Attorney General wishes to reiterate that position herein and intends to continue that representation on behalf of the State.
Consequently, Senator Humphrey may not technically qualify as a " representative of an interested State" as that term has been interpreted by other licensing boards.
See General Electric Company (GE Test Reactor, Vallecitos Nuclear Center) LBP-79-28, 10 NRC 578, 582 (1979).
The State of New Hampshire does not intercede herein to bar Senator Humphrey's participation in this proceeding.
In his official capacity as the State's senior senator he has indicated an interest in the subject satter of this proceeding.
Furthermore, his jurisdictional responsibility to the people of New Hampshire is distinct from that of the Attorney General.
Since the representation of the State of New Hampshire will continue to be conducteil by the Office of the Attorney General, we interpose no objection to Senator Humphrey's participation in this proceeding.
