NRC STAFF'S RESPONSE TO PETITION OF U.S. SENATOR GORDON J. HUMPHREY TO PARTICIPATE UNDER 10 C.F.R. I 2.715(c)
The NRC Staff hereby responds to the " Petition of U.S. Senator Gordon J.
Humphrey for Permission to Participate as a State Represent-ative in the Atomic Safety and Licensing Board Proceedings Pursuant to 10 CFR 2.715(c)," filed January 8,1987. I-The Staff notes that the admission of Senator Humphrey under 10 C.F.R. I 2.715(c) appears to be inconsistent with certain language in the Licensing Board's decision in General Electric Co. (GE Test Reactor, Vallecitos Nuclear Center), LBP-79-28,10 NRC 578, 582 (1979) (where a Congressman petitioned to intervene under 10 C.F.R. B ::.714, the Board noted, in dictum, that I 2.715(c) "does not apply to Congressmen");

The Staff's response to Senator Humphrey's petition was due to be fUed on January 28, 1987.
Due to difficulties caused by the recent winter storms, the Staff requested a one-day extension of time in which to file its response; Senator Humphey's office informed Staff Counsel that the Senator did not oppose the Staff's request, and the request was then granted by the Licensing Board Chairman.

Notwith-standing the above, the Staff does not object to Senator Humphrey's participation in the Seabrook offsite emergency planning proceeding under 10 C.F.R. I 2.715(c).
The Staff notes that Senator Humphrey may have wished to express his interest in this proceeding in a limited appearance statement under 10 C.F.R.
I 2.715(a), or as an intervenor with party status under 10 C. F.R. I 2.714.
The Staff will contact the Senator's office to clarify the extent to which he wishes to participate in the proceeding and will inform the Board of the outcome of these discussions.
