Dear Mr. Reis:
The commission has asked me to respond to your letter of December 12, 1986 regarding an Atomic Safety and Licensing Board's treatment of a license amendment filed by Florida Power &
Light Company for St. Lucie Plant Unit 2.
The Secretary of the Commission on December 23, 1986 responded to your December 8, 1986 letter on the same subject.
Your December 12, letter appears to focus primarily on the Licensing Board's letter of December 9 to Florida Power & Light and the NRC staff.
There the Licensing Board expressed its concerns regarding whether the proposed license amendment satisfies the requirements of General Design Criteria 5.
If a Licensing Board in evaluating a license amendment application determines that an issue which has not been raised by the parties warrants examination, it is appropriate for the Board to inform the NRC staff and the licensee of its concerns so that the issue can be resolved outside of the context of the amendment proceeding.
Such an approach is consistent with the agency's responsibility to assure protection of the public health and safety.
On January 16, 1987, the Licensing Board dismissed the request for a hearing and terminated the proceeding concerning the St.
Lucie amendment request.
The Commission sees no basis to take further action at this time.
