Dear Administrative Judges:
This morning, counsel received a copy of LILCO's letter to the Board dated August 28, 1986.
The Governments will respond appropriately next week to the content of the letter.
Preliminarily, it should be noted that LILCO's letter is out of order:
it is unauthorized; it mischaracterizes the facts; it seeks to compromise the legal rights of the Governments and the millions of citizens whom they represent; and it pressures the Board to abandon lawful hearing procedures.
LILCO's quotation of a self-serving letter to the President is just the most recent example of its periodic veiled threats to the NRC of political intercession if the NRC does not cater to LILCO.
The Governments ask only that this Board follow the lawful procedures established by the NRC's regulations and secured by the due process guarantees of the United States Constitution.
