NRC STAFF PROGRESS REPORT AND ANNOTATED BIBLIOGRAPHY I. PROGRESS REPORT 4 This progress report is prepared in response to the Licensing Board's " Memorandum and Order (Progress Report and Notice of Available Documents)" dated June 6,1986.

1. REVIEW OF REVISED PORTIONS OF CPRT PROGRAM PLAN Applicants have submitted four new or revised sections to the CPRT Program Plan since SSER 13 was issued. The review progress of each is as follows

3. IE INSPECTION OF TERA DESIGN ADEQUACY PROGRAM IE inspection report 50-445/85-17, 50-446/85-14 dated January 21, 1986 documented IE's ' team inspection of the Design Adequacy Program (DAP), specifically with respect to scope, review checklists and personnel qualifications. The DAP is covered in DSAPs VIII through XI, and includes both self-initiated and external source issue reviews. During May and July 1986, IE followed up on the above inspection and inspected TERA's in-process reviews under DSAPs VIII through XI. The team inspections occurred at the four TERA locations: Bethesda, CPSES site, Berkeley and San Jose, and involved approximately four weeks (440 man-hours) of inspection.

The intent was to evaluate whether 1) the TERA review samples were representative, such that areas reviewed could be extrapolated to areas not reviewed, and 2) the TERA reviews had adequate depth.

Inspection reports are currently being prepared.

In parallel with the above technical inspections of DAP implementation, IE also inspected the implementation of TERA's DAP Quality Assurance Program. Inspection reports will be issued, i

The Applicants' July 30, 1986 Progress Report indicates that the Applicants are currently considering the development of

comprehensive corrective action plans to resolve preliminary findings (Discrepancy / Issue Resolution Reports) and their implications.

i Future IE inspections will focus on corrective actions, and therefore will be dependent on these developments.

4. REGION IV PROGRESS Region IV's inspection of the CPRT Program and Issue-Specific Action ' Plan implementation is currently being conducted 'in the following three areas:

o Results Reports and Issue-Specific Action Plans (ISAPs) o ISAP VII.c Construction Reinspection / Documentation Review Plan o CPRT Onsite QA/QC Activities I

I Region IV's completion of inspection activities related to the results reports and ISAP VII.c is dependent on the CPRT schedule.

Region IV has completed approximately 70% of the planned inspection of the ISAP VII.c construction reinspection activities. Region IV inspections of ISAP VII.c are concentrating on the Evaluation Research Corporation (ERC) overview inspections and documentation reviews. Evaluations of Applicants' submitted results reports are in preparation.

Since September 15, 1985, Region IV has received allegation cases from seventeen sources. One case was closed in NRC Inspection Report 50-445/85-18 and 50-446/85-15; seven other cases have been

! closed but are pending issuance of inspection reports and closure I with allegers. One case was referred by Region IV to the Applica:lts by letter dated May 30, 1986. The remaining cases are I

pending further information and/or inspection.

5. STAFF COMMENTS ON CASE PROGRESS REPORT In its Progress Report filed August 11, 1986, CASE makes the following assertions:

Discovery of the Staff is essentially halted due to the Staff decision to require compliance with the requirements of 10 CFR II2.720(h) and 2.744 as a prerequisite to further discovery. Many outstanding FOIA requests by the Government Accountability Project relating to issues relevant here are unanswered and require perfecting appeals and court challenges.

Progress Report at 4. The Staff believes that the foregoing statement mischaracterizes its position on discovery. The Staff has made no across-the-board decision to insist that CASE comply with '

the requirements of 10 C.F.R Il 2.720(h) and 2.744 as a prerequisite to future discovery of the Staff. The Staff, as a general matter, continues to be willing to go forward with voluntary discovery without invoking those regulations based on its assessment of each individual request.

II. ANNOTATED BIBLIOGRAPHY The- following annotated bibliography is a computer-generated report prepared from the NRC's document control system. It lists all documents originated by NRC that have been sent to TUGCO relating to Comanche Peak that were indexed during the period June 6, 1986 to August 26, 1986, inclusive, b Since the Board instructed the parties "to err on the side of inclusiveness" (June 6, 1986 Memorandum, p. 3) and since the computer-generated list is not amenable to a sharper focus, it should be noted that the listing of any particular document does not constitute a determination by the Staff of the document's relevance to either the OL or CP extension proceedings.

In addition, the Board should be aware that it (as well as the parties) is now (since June 1986) on the service list for all Comanche Peak documents originated within the Office of Nuclear Reactor Regulation and will be placed on standard distribution for all Comanche Peak documents originated by NRC Region IV as of the date of this filing.

Therefore, the Board will be able to read in full any document listed in the bibliography.
