Mr. Dahl represents the Central Valley Water Reclamation Facility (CWRF) which is situated in Salt Lake City, UT on a 168-acre site that includes the 128-acre former Vitro Processing Site. Under UMTRCA Title I, DOE is removing tailings from the Vitro site to a remote location 90 miles away in Clive, UT. Mr. Dahl was accompanied by EPA Region VIII representatives, Mr. Dahl's lawyers and a Department of Justice lawyer. The NRC staff had not expected all the various organizations and people at the meeting, since earlier discussions with Mr.  ;

Dahl indicated a small informal meeting Mr. Dahl's stated purpose for the meeting was to cbtain from NRC an early determination of completion on a part of the Vitro site, to allow construction work needed to expand the CWRF and increase its capacity. The expansion construction is necessary to meet a July 1, 1988 deadline under the Clean Water Act for the CWRF to meets its NPDES effluent limits. On behalf of EPA, D0J is suing the CWRF to meet that deadline and provide additional capacity of the CVWRF to eliminate current NPDES violations at older satellite treatment facilities which will continue to be used until the CVWRF is expanded. Prior to meeting the NRC staff was unaware of these circumstances.

Mr. Dahl was under the impression that the NRC was the obstacle on the critical path to certification.

NRC staff indicated that he was misinformed, and that DOE had to determine that remedial action had been completed. We informed Mr. Dahl that we have received no such certification, and the most that NRC could do was to expedite review and concurrence upon receipt of DOE's certification. The DOE representative suggested that Mr. Dahl meet with DOE in Albuquerque to discuss the status of the completion certification process, and NRC offered to attend the meeting. The meeting has been scheduled for 9:00 a.m. on January 14, 1987, in the DOE Albuquerque Office.

After the Albuquerque meeting was arranged, Mr. Dahl thanked all participants for their participation and efforts toward resolving his concerns.
