SHANNON'S NOTICE OF INTENTIONsTO PARTICIPATE ON NEWLY ADMITTED CONTENTIONS AND OBJECTION TO AND MOTION FOR RECONSIDERATION OF HEARING SCHEDULE INSOFAR AS IT IS A MOTION TO DELAY THE COMMENCEMENT OF THE HEARINGS F
Under date of March 2, 1987, the Attorney General of the Commonwealth filed, inter alla, a motion to reconsider the hearing schedule.
The gravamen of the motion is 10 CFR 2.743(b) which states that written testimony shall be served upon parties at least 15 days before the hearing session at which it is to be offered.
The Commonwealth argues that the hearing schedule must be changed because it contemplates the start of hearings only 10 days after the last day for filing h31 DOC 5

The_ argument ignores the context of the cited regulation and the scheduling order.
The regulation talks about service before the hearing date and service includes service by regular mail.-
The regulations assume a
'five' day period to be-added to all "due dates" when service-has been made by mail.
Thus the thrust of the regu'lation is to have the written testimony in the hands of the parties at least 10 days before the hearing.
The scheduling order which this Board has. issued assumes that the parties receive the testimony on the date indicated.
Thus there is assurance that the contemplated ten days will be available_to prepare for the hearing.
In addition to the foregoing, 10 CFR 2.718(e) gives essentially plenary authority in scheduling matters to a Licensing Board.
A second ground asserted for rescheduling is the alleged requirement of a prehearing conference.
Assuming that 10 CFR 2.752 is properly read as mandating such an event in every operating license case, the most it can be said to mandate is one such conference.
We are aware of no authority, and the Attorney General of The Commonwealth cites none, which requires the holding of a prehearing conference before each different phase of the hearing where, as here, the operating license case is being tried in phases.
