APPLICANTS' RESPONSE TO BOARD REQUEST FOR SCHEDULE FOR RESPONSE TO MEMORANDUM OF 8/8/86 (Assistance to the Board)

In its Memorandum (Assistance to the Board) of August 8, 1986, the Board requested that the Applicants respond to several Board requests for information.

At the prehearing conference session on August 19, 1986, the Board ordered the l

Applicants to file by August 22, 1986 a senedule for responses to the request.

The Applicants intend to respond to those requests within 45 days from this date, and presently expect to be able to supply the information called i

for in paragraphs 1, 2 and 3 of the request within such time i

frame.

practicable, appropriate or legally required is a matter that the Applicants expect to address fully and present to the Board within that period.

The Applicants wish, however, to apprise the Board of the following points:

1.

In making the foregoing undertaking, the Applicants in no respect waive any objection heretofore claimed in respect of "pending discovery requests by CASE," including, without limiting the generality of the foregoing, its objection to the relevance of such requests to Contention 5.

2.

In making the foregoing undertaking, the Applicants' do not accede to the statements of the Board which are set forth in footnote 1 of the Board's memorandum.

3.

Applicants do not agree with or accede to the suggestion expressed orally at the prehearing conference to the effect that because Applicants did not seek reconsideration of the non-manditory " request" of August 8, 1986, (a document which in fact contained no order or ruling) the Applicants somehow bound themselves to respond to all questions.
