, Unit I from June 30, 1983 to June 30, 1986. That request was approved and on May 1, 1984, an Order extending the latest construction completion date for Unit 1 to June 30, 1986, was issued.
By letter dated May 7, 1986, Public Service Company of New Hampshire requested an extension of the latest construction completion date for Seabrook Station, Unit 1, from June 30, 1986, to June 30, 1987.
In their May 7,1986, letter, the applicant noted that construction of Unit 1 is essentially complete and that they expected to be physically ready to load fuel on June 30, 1986. However, the applicant also noted an uncertainty with regard to the necessary regulatory approvals for fuel loading and low power operation by June 30, 1986. The necessary regulatory approvals are dependent on a decision favorable to the applicant on certain safety issues by the Atomic Safety and licensing Board (ASLB). The schedule for the ASLB decision is beyond the control of the applicant.
l In their May 7, 1986, letter the applicant further noted that delays in the formulation of offsite emergency plans by various state and local governmental entities assure that NRC approval for full power operation will not be given by June 30, 1986.
Reasonableness of Period of Time Requested The applicants requested that the construction permit completion date be extended to June 30, 1987.
In support of this they state the uncertainty in l
i when the necessary NRC regulatory apporvals (which is related to the ASLB and various state and local governments actions) will be forthcoming. NRC regulatory approvals could be as late as the spring of 1987; therefore, the staff agrees that the period of time requested by the applicant is reasonable.
Conclusion The applicant's request for an extension is merely for the time to obtain the necessary NRC approval and is not to seek authorization for activities not previously authorized.
It does not involve a significant increase in the probability or consequences of an accident previously evaluated, or create the possibility of a new or different kind of accident from any accident previously evaluated, or involve a significant reduction in a margin of safety. Accordingly, the NRC staff has concluded that the action does not involve a significant hazards consideration.
Noting that several of the matters causing delay for loading fuel is beyond the applicants' control, the NRC staff further concludes that, pursuant to 10 CFR 50.55(b), the applicants have shown good cause for the delay and that the requested extension is for a reasonable period of time.
