Dear Mr. Hazle:
This is in response to your request dated December 22, 1986, for a determination pursuant to 10 CFR 150.15a(a) that all applicable standards and requirements have been met with regard to the termination of the -
licenses for three uranium processing facilities previously licensed by the State of Colorado. We have reviewed the information regarding the three licenses provided as attachmants to your December 22, 1986 letter.
Our evaluations and conclusions with respect to termination of the licenses are discussed below.
Our review indicates that Homestake Mining Company's Pitch Uranium Mill Project and the Pioneer Uranium Mill Project never conducted uranium recovery operations. Therefore no byproduct material was ever produced and decontamination of the sites or byproduct disposal-was not necessary.
The third site, the Wyoming Minerals Corporation (WMC) Grover In Situ Uranium Processing Facility (State License No. 140-035), did produce byproduct material which_was~ allegedly removed. Close~ scrutiny of your attachments indicates that three areas were substantially above normally expected background levels for direct gamma radiation (25-180 uR/h) as reported in a March 18, 1982, Colorado Department of Health (CDH) interoffice communication memorandum. Another CDH interoffice memorandum dated December 21, 1982, provided the rationale for termination of the license and stated that CDH staff conducted a final inspection on September 7, 1982, and observed WMC's contractor remove the remaining contaminated soil and verified proper disposal of it. However, since there is no documentation supporting the final inspection conducted on September 7, 1982, we cannot conclude that it was decontaminated properly.
