NRC's FY 1999 PROPOSED FEE RULE

Dear Mr. Mosley:

The NRC is re,4esting expedited processing of this proposed FY1999 fee rule in order to meet }

statutory requirements.

The NRC is required by the Omnibus Budget Reconciliation Act (OBRA-90) to collect approximately 100 percent of its budgeted costs through license and annual fees, and is required to do so through notice and comment rulemaking each year. In order to affect this mandate to bill and collect by September 30,1999, it is imperative that the final rule become effective no later than August 10,1999, to provide a 30-day interest-free payment period in accordance with the Debt Collection Improvement Act of 1996. Because the fee rule is a major rule under The Small Business Regulatory Enforcement Faimess Act, the final rule must be published no later than June 10,1999, to become effective August 10,1999. Therefore, the proposed fee rule must be published no later than April 1,1999, to allow for the 30-day comment period and sufficient time for us to review and analyze the comments and develop the final rule.

As you can see, in order to assure we meet our Congressional mandate to bill and collect l 100 percent of our budget by September 30,1999, the timing of the publication of the proposed and final rules is critical to meeting our goal. l l apologize for providing you the rule so late in the month. Any assistance you can lend toward getting our proposed fee rule published in the month of March will be greatly appreciated. It is likely that a similar request will be made for the final rule.

SUMMARY

The Nuclear Regulatory Commission (NRC) is proposing to amend the licensing, inspection, and annual fees charged to its applicants and licensees. The proposed j

- amendments are necessary to implement the Omnibus Budget Reconciliation Act of 1990 L (OBRA-90), as amended, which mandates that the NRC recover approximately 100 percent of its budget authority in Fiscal Year (FY) 1999, less amounts appropriated from the Nuclear ,

' Waste Fund (NWF) and the General Fund. The amount to be recovered for FY 1999 is

- approximately $449.6 million.

I DATES:: The comment period expires (30 days after publication). Comments received after this date will be considered if it is practics) to do so, but the NRC is able to ensure only that

, comments received on or before this date will be considered. Because OBRA-90 requires that 1
