1 MEMORANDUM TO: Frank J. Miraglia, Jr.

Deputy Executive Director for Regulatory Programs Carl J. Paperiello, Director Office of Nuclear Material Safety and Safeguards Karen D. Cyr, General Coun el S

FROM: Paul H. Lohaus, Director Office of State Programs , b' hb l

SUBJECT:

INTEGRATED MATERIALS PERFORMANCE EVALUATION PROGRAM (IMPEP) REVIEW OF NORTH DAKOTA RADIATION CONTROL PROGRAM I

This memorandum transmits to the Management Review Board (MRB) a proposed final report (Attachment 1) documenting the IMPEP review of the North Dakota Radiation Control Program.

The review of the North Dakota program was conducted by an interoffice team during the period April 13-16,1999. The team issued a draft report to North Dakota on May 10,1999, for factual comment. North Dakota sent factual comments by letter dated June 7,1999 from Murray G.

Sagsveen, State Health Officer (Attachment to proposed final report). )

Based on the findings, the review team recommends to the MRB that the State be found  :

satisfactory for five of the six performance indicators. The review team recommends to the MRB that the State be found unsatisfactory for the indicator, Status of Materials inspection Program. l Additionally, the team recommends that North Dakota's program, as a whole, be considered adequate, but needs improvement and compatible with NRC's regulatory program.

The MRB meeting to consider the North Dakota report is scheduled for Wednesday, June 30, '

1999 from 1:00 - 3:00 p.m. In Two White Flint North, Room 2 B-5. In accordance with Management Directiye 5.6, the meeting is open to the public. The agenda for that meeting is attached (Attachment 2). \
