SUBJECT:
WITPPOLDING FROM PUBLIC DISCl0SURE - AW-86-048 - AMENDMENT 3 TO WAPWR RESAR-SP/90 PDA MODULE 5, " REACTOR SYSTEM" By your application dated June 4,1986 and affidavit, dated November 1,1982, you submitted Amendment 3 to WAPWR RESAR-SP/90 PDA Module 5, " Reactor System" and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790.
You stated that the submitted information should be considered exempt from mandatory public disclosure for the following reason:
The document to be withheld identifies specific design features and improvements which the Westinghouse Advanced Pressurized Water Reactor (WAPWR) will have in order to meet current regulatory requirements.
In addition it establishes the WAPWR position with respect to each requirement.
Public disclosure of this information is likely to cause substantial harm to the competitive position of Westinghouse as it would reveal the description of the improved design features of the WAPWR; plans for future design, testing and analysis aimed at design verification; and demonstration of the design's capability to meet evolving NRC/ACRS safety goals.
This information is of a competitive value because of the large amount of effort and money expended by Westinghouse over a period of several years in carrying out this particular development program.
Release of this information would enable competitors to use the information for commercial purposes without purchasing the right from Westinghouse to use the information.
We have determined that the subject information marked as proprietary, should be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(bl of the Atomic Energy Act of 1954, as amended.

. We therefore approve your request for withholding pursuant to 10 CFR 2.790 and are withholding the subject document from public inspection as propsietary.
Withholding from public inspection shall not affect the right, if aby, of persons properly and directly concerned to inspect the documents, jfthe need arises, we may send copies of this information to our consultants working in this area. We will, of course, insure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You should also understand that the NRC may have cause to review this determination in the future, such as if the scope of a Freedom of Infonnation Act request includes your information.
In all review situations, if the NRC needs additional information from you or makes a determination adverse to the above, you will be notified in advance of any public disclosure.
