Dear kr. ? owe r By your letter and affidavit dated July 18 1997, you submitted a response to NRC's requast for information with regard to a licensed operator positive drug test and requested that portions be withheld from public disclosure pursuant to 10 CFR 2.790.

You stated that the submitted information should be considered ex. 4, from macdctory e public disclosure because the information has been held in confidence by its owner, the information is of a type e,ustomarily held in confidence by its twner, and the infomation is contained in personnel and medical files and similar files, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy.-

We have reviewed your request and have detemined thtt the submitteri information sought to be withheld contains privacy information. The t'itness-for-duty information concerning the licensed operator is baing held by 1RC in a Privacy Act System of Records, NRC-16 Facility Operator Licensees Record Files, ind, therefcre, will only be released under conditions permitted Ly the Privacy Act and that System of Records.
