REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DI; CLOSURE (BYRON NUCLEAR POWER STATION)

Dear Mr. Graesser:

By your letter dated October 6,1997, you submitted a response to NRC's request for information with regard to a licensed operator positive alcohol test and requested that portions be withheld from public disclosure pursuant to 10 CFR 2.790.

You stated that the submitted information should be considered exempt from mandatory public disclosure because the information includes sensitive, confidential information, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy.

We have reviewed your request and have determined that the submitted p information sought to be withheld contains privacy information. The fitness-for-duty information concerning the licensed operator is being held by NRC in

a Privacy Act System of Records, NRC-16, Facility Cperator Licensees Record Files, and, therefore, will only be released under conditions permitted by the Privacy Act and that System of Records.
