This is an 3 affirmation session dealing with SECY 86-204, Commission 4 policy statement on Radioactive Waste Below Regulatory 5 Concern. 6 Will the Secretary please review the policy 7 statement, and any other actions that we may be required to l 8 take this morning. 9 MR. CHILK: Mr. Chairman, before I present the 10 matter, the Commission is required to vote to hold this on 11 less than one week's notice. If I can get that. 12 CHAIRMAN ZECH: Aye. CHILK: The paper before the Commission is 17 SECY 86-204, Policy Statement on Radioactive Waste below 1 18 Regulatory Concern. 1 19 In this paper, the Commission is being asked to l 20 approve publication of a policy statement which establishes 21 standards and proceduras for the expeditious action on 22 petitions to exempt certain radioactive waste as below 23 regulatory concern. 24 All of the commissioners have approved a proposed 25 policy statement, with modification by Commissioner Roberts, i -a,...,-,. ~,r-. ,,-,.-,,-,.-n.-- .r-,.-,----- ,n~- .. - --, ---~,... - -, -., --,
~ ] 4 [ which is attached to our August 5 memorandum, which indicates 1 2 that the Commission will also be publishing an advance notice 3 of proposed rulemaking within ninety days. 4 The Commission has also agreed that the proposed and 5 final rulemaking on individual petition requests will be l 6 subject to Commission approval, and our requirement memo to 7 the Staff will request that the draft procedures be revised to i 8 reflect this, and request that the advance notice of proposed 9 rulemaking be provided the.
