LICENSES _XSNM070AA AND XSNM02967 FOR AMENDMENT TO CHANGE END USE STATEMENTS FROM SEVEN RELOADS EACH j

UNIT TO SIX RELOADS EACH UNIT l

1 On May 8,1997, NRC issued licenses XSNM02966 and XSNM02967 to General Electric Company which authorized the export of 497,500.0 kilograms of uranium containing 24,900.0 kilograms of uranium-235, with a maximum enrichment of 5.0 percent, for each license. The I

end use for each license was to cover seven reloads of fuel for Kuosheng Units I and ll and Chinshan Units I and 11, respectively. By letter dated September 9,1999, the licensee requested amendments to the licenses to change the end use statements from seven reloads to six reloads for each unit. On September 15 the licensee requested a waiver of the fifteen day waiting requirement of the amendment requests in the public document room in order to meet j

their customer's requirement that the licenses be amended to reflect the end use change before their proposal bid with Taiwan Power Companu will be accepted.

- The original licenses were issued only after it was determined that the exports met all the l

requirements of the Atomic Energy Act of 1954, as amended, and the U.S. Nuclear Regulatory l

Commission rules and regulations, Title 10, Chapter 1, Part 110.

The NRC staff has completed its review of the amendment requests and has concluded that the l

reduced number of reloads is of no significance and is consistent with the provisions of the Atomic Energy Act of 1954, as amended.

Under NRC regulations found at 10 CFR Section 110.82 members of the public are afforded i

fifteen days to file an intervention petition or hearing request from the date that an amendment request of this type has been received by the NRC's Public Document Room (PDR). Although the 15 days has not expired, because of the non-controversial nature of the expor1s, the fact that l

the original applications were posted in the POR without an intervention petition being filed, and the need for the licenses to be amended before the licensee's proposal bid will be accepted, I am issuing the license amendments at this time.

-The waiver of this 15 day requirement is authorized by law and meets all the requirements of the Atomic Energy Act as amended.
