Dear Congressman Roth:

This is in response to your letter of January 19, 1987 concerning a question by Mr. Clyde Hanley whether or not nuclear plant employees are checked for possible drug usage.

In August 1986, the Comission published a Policy Statement on Fitness for Duty of Nuclear Power Plant Personnel. That statement expresses the Commission's expectations that operating reactor licensees will take all reasonable precautions to ensure that drug use does not adversely impact the safe operation of nuclear power plants and the public safety.

The basis fur issuing a policy statement rather than a rule was that the nuclear industry 5

had made and was continuing to make substantial progress in achieving this objective. The Chief Executive Officers of all utilities which operate nuclear power plants have committed to the establishment of fitness for duty progrems which meet standards developed for the industry)by the Edison Electric Institute.

The Institute of Nuclear Power Operations (INP0 is evaluating each utilities' implementation of these programs. The industry program includes drug testing as a condition for employment and in cases where there is cause to indicate the possibility of drug involvement by individuals.

In addition, some utilities have established programs which include periodic drug testing or randomly scheduled testing.

It is important to note that there are other major elements, besides chemical testing, that are important to the administration of an effective fitness for duty program. Other important elements include the establishment of clear company policies, training of managers to recognize aberrant behavior, training of employees on company policies and the effects of drug and alcohol abuse, development of employee assistance programs, and coordination with local law enforcement agencies. These elements are all part of the guidelines contained in the Edison Electric Institute's " Guide to Effective Drug and Alcohol / Fitness for Duty Policy Development." This guide is being used by all nuclear utilities in the development and implementation of their programs.

I hope this brief description of nuclear industry fitness for duty programs is responsive to your request and addresses Mr. Hanley's concern.
