The subject is SECY-87-37.
It's a final, 12 rule of 10 CFR 73.57, dealing with implementing requirements 13 for licensee access to FBI criminal history data.

In this paper, the Commission is being asked to act 14 15 on a final rule which will implement procedures for the 1
16 control and use of criminal history data received from the FBI 17 as part of the federally mandated criminal history checks of i
18 individual granted unescorted access to nuclear power i
19 facilities or access to safeguards information by power 20 reactor licensees.
21 Chairman Zech, Commissioners Roberts, Bernthal, and 22 Carr have approved the final rule with the modifications 23 provided by the Staff on the 24th of February, with changes by i
24 the Chairman and Commissioner Asselstine to retain a reference 25 to the First Amendment in the rule and specify in one of the

subsections that " Licensees must provide at least ten days for p
2 workers to challenge the FBI record."
3 Commissioner Asselstine disapproves, because he 4
would have deleted Section (b) (2) (b) on temporary worker l
5 access and would deal with this issue in additional rulemaking.
