SUBJECT: NRC NOTICE OF VIOLATION AND INSPECTION REPORT NO. 50-341/97013

Dear Mr. Gipson:

On September 22,1997, the NRC completed an inspection at your Fermi 2 reactor facility. The

enclosed report presents the results of that inspection.

During the 5 week period covered by this inspection period, improvements were noted in the

conduct of plant operations due to effective implementation of the Operational Excellence Plan.

The results of self assessment activities by your quality assurance department were similar to

the results of our inspection activities regarding the effectiveness of performance improvernent

initiatives associated with the Operational Excellence Plan. Also during this period, adverse

trends in personnel errors during the conduct of work activities and equipment deficiencies

associated with solenoid valves were identified. You promptly recognized these problems and

took immediate corrective actions, in contrast, corrective actions to address Reactor Core

isolation Cooling system oilleaks identified during surveillance testing were not promptly

implemented, resulting in the unnecessaryinoperability of this Engineered Safety Feature system

for three days.

Based on the tesults of the August 6,1997, Pre-decisional Enforcement Conference, the NRC

has determined that a violation of NRC requirements occurred. The violation is cited in the

enclosed Notice of Violation (Notice) and the circumstances surrounding it are described in detail

'in Inspection Report No. 50-341/97002. Your staff failed to follow the requirements of the

corrective action program for documenting and reporting this type of issue promptly. By not

documenting this issue in a Deviation Event Report, the significance was not promptly evaluated,

nor was management aware of the issue until the NRC became involved much later, We

determined that your staffs corrective actions were adequate to prevent recurrence and tMt

escalated enforcement action was not appropriate for this issue. We are therefore issuing a

Notice for a Severity Level IV violatio.n for failure to follow procedures.
