OF THE SEPTEMBER 8,1999, MEETING WITH THE NUCLEAR POWER INSTITUTE AND THE PUBLIC TO DISCUSS THE CONTINUED DEVELOPMENT OF THE REVISED REACTOR
' OVERSIGHT PROCESS.
On September 8,1999, a public meeting was held between the NRC and the NEl to continue exchanging information and views in further development of the concepts for improving the process of overseeing the safety performance of nuclear power reactors. The meeting agenda, summary, a list of those who attended, and a copy of written information exchanged at the meeting are attached.

- 1. General open topic discussion NEl indicated that the communication position would be clarified and added to the next revision of the Performance Indicator Guideline document.
Emergency Preparedness Cornerstone Questions and Answers were distributed. See l Attachment. '
- 2. Safety System Unreliability Performance Indicator NRC presented their draft Safety System Unreliability performance indicator. See Attachment.
The indicator was defined and contrasted with the INPO indicator, where the INPO indicator is based upon calculation while the NRC indicator is based upon testing the consistency of observed performance against unreliability goals. Agreed that NRC would provide at the next session a set of " ground rules" for rnore clearly defining and calculating this indicator.
- 3. Enforcement issue As a follow-up to the last meetirig (August 25,1999) the Office of Enforcement discussed the 50.9 issue of submission of performance indicator data to the NRC by licensees. The Office of i Enforcement indicated that for the pilot plants no enforcement action would be made (except for willful inaccurate submissions)_ for inaccurate information submitted. A 50.9 violation could arise if inaccurate and incomplete information was material to NRC. Material is meant to mean data was used or might have been used by NRC and would impact regulatory actions if the NRC had looked at the information. That there are inaccuracies that would have influenced regulatory response by NRC. Discussion by NEl and industry representatives was based around types of violations and severity of violations. The Office of Enforcement indicated that NRC would continue to consider its approach regarding violations and severity issues.
- 4. Security Performance index lasue NRC discussed its current approach to developing its security performance index. The Physical Protection SDP Attachment #3 DRAFT was distributed. See attachment.
- 5. Supplemental inspection Procedures NEl discussed their comments related to the supplemental inspection draft procedures distributed at the last meeting (August 25,1999). NEl distributed their written draft Comments
