Dear Mr. Lochbaum:
I am responding to your letter of July 26,1999, in which you expressed, on behalf of several stakeholders, dissatisfaction with the July 1,1999 revisions to the 10 CFR 2.206 petition review process documented in Management Directive 8.11 (MD 8.11), " Review Process for 10 CFR 2.206 Petitions." The July revision is the completion of the first phase of a continuing' effort to enhance the effectiveness of our reviews and thereby improve public confidence in the petition process. The MD 8.11 revision reflects several actions which the staff was able to implement relatively quickly in response to a rather limited stakeholder survey and from staff experience with the existing process. Our principle objectives were to facilitate greater interaction between petitioners and staff and to provide opportunities for more active petitioner involvement in the process.
We recognize that this particular revision might not adequately address all of the stakeholder concarns. We regret that all of your comments were not addressed in the Ju'y revision to MD 8.11. However, partially as a result of concerns such as you have expressed, the staff intends to solicit a larger number of stakeholder comments by publishing MD 8.11 in the Federal Reoister for an extended comment period. The staff will also hold at least one public meeting with your task force in the near future to understand and explore fully its specific concerns and recommendations. We would welcome any suggestions you may have regarding the agenda and format of this meeting. The staff will also hold at least one additional public meeting with other stakeholder groups. By affording these opportunities, the Commission hopes to encourage the submission of all concerns and recommendations on the 2.206 process.
Following the receipt and consideration of comments, a second Federal Reaister notice will be published which will contain responses to the comments and recommendations received, it will also explain any changes to be made in MD 8.11 and any plans for rulemaking as a result of the public process The Commission appreciates your continued participation in our efforts to improve this important vehicle for public participation in the NRC's mission.
