NRC REGION I INSPECTIONS AT THE WEST MIFFLIN, PA SITE
Dear Ms. Rivera:
As Joseph Nick of my staff discussed with your company representatives, the Nuclear Regulatory Commission (NRC) has been reviewing records to ensure that facilities, where activities were authorized by Atomic Energy Commission (AEC) and NRC licenses that have been terminated, are suitable for release for unrestricted use in accordance with current NRC guidelines. As you may be aware, the NRC and its predecessor, the AEC, issue licenses that authorize the use of various radioactive materials.
A contractor for the NRC, Oak Ridge National Laboratory (ORNL), initially reviewed each terminated license file and scored it according to a system designed to identify facilities that require additional review by the NRC staff. In general, files that indicate that radioactive material may have been used at particular facilities, but which do not include adequate final survey records for those facilities, are identified for our additional review. The review by ORNL identified License Nos. 37-00345-03 and SNM-6 (both Retired), issued to International Chemical I
and Nuclear Corporation (ICN), Inc., as files describing sites that require additional review. The NRC Region I staff reviewed these files and determined that additional action was necessary since the information in the files did not provide sufficient detail to conclude that the facilities at West Mifflin, Pennsylvania meet current guidelines for unrestricted release, j
A scoping survey was performed by the Oak Ridge Institute of Science and Education (ORISE) in 1994 at the former storage facility located at 440 Lebanon Road, West Mifflin, Pennsylvania.
This survey identified radioactive material at the West Mifflin site.
Remediation, restoration and final survey of the site was performed in accordance with the ICN Site Remediation Plan (SRP) that was submitted to the NRC on August 19,1998. The NRC had written a letter to ICN, dated November 10,1998, stating that the NRC had no objection to commencement of remediation work at the former ICN site as outlined in the SRP. On April 30,1999, ICN Pharmaceuticals, Inc. submitted a Final Status Survey (FSS) Report that was prepared by a remediation contractor. We have reviewed the FSS Report and note that all I
final survey measurements were less than the values specified in the SRP.

2 West Mifflin Site On December 9,1998 and on December 21,1998, NRC Region I staff conducted an inspection of the former storage facility located at 440 Lebanon Road, West Mifflin, Pennsylvania. The inspectors also performed confirmatory radiological surveys of the facilities which included soil samples from interior and exterior areas. The preliminary findings of this inspection were discussed with ICN representatives at the conclusion of the inspection. With the exception of two areas, radiation and contamination levels were less than the values specified in the SRP.
These two areas were subsequently remediated and the final survey results were also less than the values specified in the SRP Based on the findings described in the ICN FSS Report, the facilities at 440 Lebanon Road, West Mifflin, Pennsylvania meet the epplicable requirements for release for unrestricted use.
Therefore, we plan no further actions on this property.
In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter will be placed in the Public Document Room. We will also provide copies to representatives of the Commonwealth of Pennsylvania.
