are our comments:
-The letter to Mr. Fry shouldLinclude aitatement that1we feel the commitments contained in the letter and the approach of a consent decree seem to be appropriate'for the' issue involved.
In addition to thanking them ~for the opportunity to comment on the letter, we should indicate that the State should not hesitete to contact us if'they f require assistance on compiling iaformation, such as could be obtained from our licensing database.
We_ recommend Item E of the Consent Decree be modified to require the subject report be provided following the 180 day cut-off date rather than
-at the close of the second quarter.
The information'that is to be included in-the report is timely and it is important that the State and NRC be
-provided the information as soon as Jossible.
If the second quarter ends prior to the 180 day cut-off date (wlich is likely to be the case).
complete data would not be obtained until the end of third quarter (another 90 days). Therefore, a special report after the end of the 180 day cut off would seem to be a better alternative.
-With these comments. Larry Camper concurs with the letter for IMAB.-Therefore.
.you do not-need to have myself or Don on concurrence.
I recommend you not seek OGC concurrence.since we are not issuing any policy decisions in the letter.
