NOTICE OF VIOLATION Illinois Power Company License No. NPF-55 As a result of the inspection conducted on December 1 through 5, 1986, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1985), the following violation was identified:

10 CFR 50, Appendix B, Criterion V, as implemented by the Illinois Power (IP) Company Operational Quality Assurance Manual requires that each IP organization is responsible for using formal instructions, procedures, drawings, and related material for performing activities affecting the quality or functions of applicable systems, structures, or components.

Procedure CPS No. 1014.03, Temporary Modifications, requires the following:

Paragraph 8.3.3.2 requires that all Safety Related modifications shall be reviewed and approved by the Facility Review Group within 10 days after installation.

Paragraph 8.4.1 requires that if it is desired to leave a temporary modification in effect beyond the one month limit or beyond the time allowed by the Manager - CPS, the temporary modification permit shall be presented to the Manager - CPS for approval of the extension with the new removal date annotated.

Paragraph 8.6 requires that monthly and quarterly audits of the active temporary modifications be perfonned by plant staff.

Contrary to the above requirements, an NRC inspection on December 3, 1986, identified the following deficiencies in the administrative control of temporary modifications:

Five safety related temporary modifications had been installed greater than 10 days without the review and approval by the Facility Review Group.

Seven temporary modifications were still installed beyond the time allowed by the Manager - CPS, without receiving approval from the Manager - CPS for the exten:; ion.

Plant Staff audit of active temporary modifications was not performed for the month of flovember 1986.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
