               SUBJECT:        NRC INSPECTION REPORT NO. 50 373/97011(DRP); 50 374/97011(DRP),
                               NOTICE OF VIOLATION, AND EXERCISE OF ENFORCEMENT DISCRETION
               Dear Mr. Subalusky:
              Cin August 8,1997, the NRC completed an inspection at your LaSalle reactor facility. The
              enclos6d report presents the results of this inspection.
              During this 6-week inspection period, your conduct of activltles at the LaSalle facility was
              generally characterized by inconsistent personnel performance and continuing problems with the
              surveillance and out-of service programs. Personnel errors resulted in two missed surveillances,
              several missed opportunities to identify a broken fuel rod in the spent fuel pool, and the
              implementation of a seismic equipment modification without making revisions to the affected
              operating procedures for the equipment.
              Based on the results of this inspection, the NRC has determined that three violations of NRC
              requirements occurred as described in the attached Notice of Violation (Notice). The first
             violation involved the failure to ensure effective corrective actions for a previously identified
              deficient procedure. The inspectors determined that a manual backwash for the 1A emergency
             diesel generator cooling water strainer could not be performed as specified by a procedure which
             was previously revised to address the manual backwash function. The second violation
             pertained to two instances where plant personnel failed to follow plant administrative procedures.
             The third violation involved the failure to perform required surveillance tests on the process
             radiation monitors. Although the third violation was identified by members of your staff, this
             violation was cited because its cause was similar to a previous violation for a missed survelttance
             identified in inspection Report 50 373/97003; S0 374/97003. Continued problems with
             implementation of your surveillance program remains a concem. In your response to these
             violations, please include a discussion on actions taken or planned to ensure surveillance tests
             are performed as required.
             The violations cited in the enclosed Notice and the circumstances surrounding them are
             described in detailin the subject inspection leport. Please note that you are required to respond     I
             to this letter and should follow the instructions specified in the enclosed Notice when preparing

             your response. The NRC will use your responsu, in part, to determine whether further
             enforcement action is necessary to ensure compliance with regulatory requirements.

          discretion and not issuing a Notice of Violation because the criteria specified in Section Vll B.2,

          Pol 6cy are satisfied. e;=#-r";, the violation is based upon your activities prior to the events
          leading to your decision in December 1996 to enter into an extended shutdown to address
          longstanding performance issues. The violation would not have been categottrod at Severity
          Levelli, the violation was not willful, and enforcement action was not considered necessary to
          achieve remedial action, in addition, actions specified in Confirmatory Adion Letter Rill 96-0088
          effectively prevent you from starting up LaSalle County Station without implicN NRC approval.

      In addition, the inspectors identified a violation of design control with respect to permanently
      storing unsecured equipment in non-qualified locations. The NRC is exercising enforcement
      discretion and not issuing a Notice of Violation because the criteria specified in Section Vll.B.2,    ,
