Dear Mr. Beach:
My staff has completed its review of the proposed reclamation plan for the Abandoned Mine Land Program Project 13, as submitted by AVI Engineering Planning and Surveying P.C. (AVI) cover letter dated October 23, 1986, as well as additional laboratory data submitted by AVI on January 29, 1987.
Our review concentrated on the radiological characteristics of the waste piles, ore piles and the heap leach pad.
It is our staff conclusion that the majority of the materials at the site represent low grade ore piles or waste materials.
Furthermore, those materials which show uranium depletion do not appear to have been processed.
This depletion is probably due to natural acid formation by way of gypsum crystal dissolution.
It is our staff conclusion that the Project 13 site does not contain byproduct materials, but consists entirely of low grade ore, waste soil materials and a constructed, but never utilized, heap leach pad.
Due to the character of these materials, the USNRC has no licensing authority over the site. We do, however, appreciate the opportunity to comment on the reclamation plan, f0 DOOJ9 y
