This is an affirmation session and I understand we
-7 have one item before us this afternoon to affirm.
Before I 8
ask the Secretary to lead us through that item, do any of my 9
fellow Commissioners have any remarks to make?

11 CHAIRMAN ZECH:
Would you lead us through the item, 12 please?
13 MR. BATES:
Mr. Chairman, the subject for this 14 afternoon is SECY-86-336A, a proposed revision to part 110 15 concerning the import of uranium from South Africa.
16 The Commission is being asked to approve a final 17 rule which amends NRC's export regulations in 10 CFR Part 110 18 concerning the import of uranium from South Africa.
The 19 proposed rule change would require any South African uranium 20 ore or oxide import license application to be considered on a 21 case-by-case basis.
22 Chairman Zech and Commissioners Roberts and 23 Asselstine have approved the rule with modifications which 24 would require the Commission to review all imports or uranium 25 in any form from South Africa on a case-by-case basis.

Commissioners Bernthal and Ca'rr have approved the original 2
staff proposed rule which would have required the case-by-case m
3 consideration of uranium ore and oxide only.

Thank you very much.
Are there any 7

8 MR. BATES:
That is all I have.
9 MR. PARLER:
Mr. Chairman, I assume from the 10 affirmation vote that was just made that the staff does have 11 the authority to make the necessary modifications and to 12 publish the rule without coming back to the Commission.
Is 13 that correct, sir?
14 CHAIRMAN ZECH:
This is my understanding.
15 COMMISSIONER ASSELSTINE:
Sure.
That is fine with 16 me.
Maybe we can just get a copy to look at.
17 MR. PARLER:
Of course, this modification to review 18 all imports will if that goes over to material which has been 19 substantially transformed, we may be to some extent at the 20 mercy of the Custom Department regulations, et cetera, in 21 identifying such things which have been substantially 22 transformed.
I hope that is recognized.

Yes.
