. NOTICE OF VIOLATION Louisiana Power & Light Company Docket: 50-382 Waterford Steam Electric Station, Unit 3 License: NPF-38

During an NRC inspection conducted January 1-31, 1987, two violations of NRC requirements were identified. The first violation' involved ~a failure to properly implement a portion of the quality assurance program. The second violation involved a failure to properly specify _the order of succession for responsibility for overall unit operation.- In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2,,

'AppendixC(1986),theviolationsarelistedbelow:

A. 10 CFR Part 50, Appendix B, Criterion VII requires, in part, that, "The effectiveness of the control of quality by contractors and subcontractors shall be assessed by the applicant or designee . . . ."

The Louisiana Power and Light Quality Assurance Program implements the requirements of 10 CFR Part 50, Appendix B, Criterion VII.

QAP 202, " Evaluation of Suppliers Quality Assurance Program," is an approved quality, assurance procedure which requires, in part, that annual evaluations of supplier quality assurance programs be conducted every 12+2 months' and also. requires that for suppliers who are conditionally accepted.the restrictions shall be listed on the qualified supplier i list-(QSL);

Contrary to the_above, evaluations were not performed within the required interval, on the QA programs for the following suppliers:

Southern _ Vital Records (1984)

Siemens-Allis (1983 and 1984)

Additionally, Siemens-Allis Co. and Foxboro Co. were both conditionally qualified suppliers. Each required an audit / evaluation prior to making a purchase. These restrictions were not entered on the QSL.

This is a Severity Level IV violation. (Supplement II)(382/8701-01)

The licensee responded to the provisions of 10 CFR 2.201 during the inspection, and the corrective actions were reviewed by the NRC inspector.

The licensee admitted to the violation and took corrective steps as

< described in the inspection report along with the steps being taken to avoid further violations. The licensee is currently in compliance, therefore, no further response is required.

B. Technical Specification (TS) 6.1.1 states, "The Plant Manager-Nuclear

. shall be responsible for overall unit operation and shall delegate in writing the succession to this responsibility during his absence."

Contrary to the above, on January'9,1987, the licensee was unable to produce documentation indicating succession responsibility had been delegated.

This is a Severity Level V violation. (SupplementI)(382/8701-04)

Pursuant to the' provisions of 10 CFR 2.201, Louisiana Power & Light Company is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice, a written statement or explanation in reply, including for Violation B: (1) the reason for the violation if admitted,

2) the corrective steps which have been taken and the results achieved, 3).the corrective steps which will be taken to avoid further violations, and
4) the date when full compliance will be achieved. Where good cause is shown, consideration will-be given to extending the response time.
