Subject:

Response to NRC Concerns About Operations at Rockwood Ouarry In the Reference 2 telephone conversation and subsequent inquiries from Messrs. Lynch and DePayette, NRC expressed concerns about potential effects of operations at the Rockwood Stone, Incorporated (RSI) quarry on safe operation of the Fermi-2 plant.

This quarry is located approximately 3 miles north-northeast of Fermi-2, whereas the two quarries described in the Fermi-2 PSAR are at least eight miles away.

Detroit Edison has obtained information on the operations at the RSI quarry and concludes that operations there have no effect on safe operation of Fermi-2.

The information and basis for this conclusion are presented in the attachment.

Detroit Edison has performed an evaluation to determine if the presence of the RSI quarry constitutes an unreviewed safety question.

Although 10CFR50.59 may not require this evaluation, its conduct ensures a comprehensive review.

The results of the 50.59 evaluation confirmed that the presence of the RSI quarry does not constitute an j

o AFFIDAVIT This affidavit is submitted in support of a request by Detroit Edison to classify the enclosed document as proprietary pursuant to Title 10 of the Code of Federal Regulations, Part 2.790.

The subject document has been prepared by Detroit Edison and is considered to contain commercial information that has been obtained from Rockwood Stone, Incorporated (RSI) on a confidential and privileged basis.

Therefore, in regard to the above, I, Frank E. Agosti, first being duly sworn do hereby depose:

1. My name is Frank E. Agosti, I am Vice President-Nuclear Operations for the Fermi 2 plant of Detroit Edison Company.

I am knowledgeable regarding matters contained herein and am empowered to execute this affidavit.

2. The document acccmpanying this affidavit, entitled " Evaluation of Quarrying Near Fermi Site", has been developed by Detroit Edison with information from RSI.

The RSI information reflected in the attachment was provided in confidence to support Detroit Edison's development of a comprehensive response on the subject quarry issue.

3. Detroit Edison is providing the document to the Nuclear Regulatory Commission for its review with respect to resolution of the quarry concern.

Edison requests that the enclosure be exempt from disclosure per 10CFR2.790(a) (4) because it contains privileged Or confidential information.

Further, in accordance with 10CFR2.7 90 (b) ( 4), the following is provided:

(a) This submittal contains information which is ccusidered proprietary information, and has been and is being held in confidence by Detroit Edison.

(b) The document contains information of a proprietary and confidential nature which is customarily held in confidence.

(c) The document is being transmitted to the Commission in confidence by Detroit Edison.

(d) The information considered proprietary is not available through any source other than Detroit Edison or RSI.
