Dear Mr. Wiley:

1 Enclosed for your review is the draft Integrated Materials Performance Evaluation Program (IMPEP) report which documents the results of the Agreement State follow-up review held in i

your offices on September 15-19,1997. Patricia Larkins, Project Manager, Office of State Programs, was the team leader for the Nebraska follow-up review. The review team's findings i and recommendations were discussed with you and your staff on September 19,1997.

, Based on the findings; the follow-up review team is recommending to the Management Review

Board (MRB) that there is no change in the finding resulting from the July 1996 IMPEP review "that the Nebraska program is adequate to protect public health and safety but needs improvement, and compatible with NRC's program."

Due to the fact that two recommendations remain open, one of which was identife:1 as 4

significant during ti,e July 1996 IMPEP review, and the fact that the State did not adequately communicate the status of the resolution of corrective actions, the team is recommending that an IMPEP review be scheduled within one yet of the date of this follow-up review.

In accordance with procedures for implementation of IMPEP, we ar' providing you with a copy of the draft team report for review prior to submitting the report to the MRB. Your review of the

draft report should focus on factual correctness of information reported by tho team. I am l asking that you provide your response to me as soon as possible, but no later than four weeks from receipt of this letter.

. The team will review the response, make any necessary changes to the report and issue it to
