In your letter dated February 10, 1987, to Mr. James P. O'Reilly of Georgia Power Company (GPC), you reaffirmed the NRC staff's position that the ASME Boiler and Pressure Vessel Code,Section XI pressure tests must i

be performed prior to the reactor being critical.

Based upon tne staff

position, GPC will imediately comence preparing the necessary procedures and Technical Specifications changes needed to assure the safe and expeditious performance of the pressure tests.

We appreciate your prompt response once you became aware of the Code Comittee s response to our inquiry regarding criticality during pressure testing.

This rapid turnaround allows GPC the time needed to generate the required procedures and Technical Specifications changes in support of the upcoming Plant Hatch Unit 1 outage, scheduled to comence on April 22, 1987.

Since completion of the Unit 1 outage is contingent upon your approval of these proposed Technical Specifications changes, we request that they be processed in a similar manner.

During the quarterly GPC/NRC meeting held on February 10, 1987, in Bethesda, Maryland, we discussed with members of the NRC staff (Hessrs.

Muller, Rivenbark, Cantrell, and Hermann) our disagreement with the NRC's position regarding the subject pressure tests and stated that we would be appealing the NRC decision regarding this matter.

Notwithstanding our full compliance with the new staff interpretation in order to avoid outage-related impact, a letter formalizing our appeal on this item, including the technical and legal bases, is being prepared and will be forwarded to you in the near future.
