DEC 1 G 1326 Robert Bernstein, M.D., Commissioner Texas Department of Health 1100 West 49th Street Austin, Texas 78756

Dear Dr. Bernstein:

We have been informed by Mr. D. K. Lacker, in a letter dated November 24, 1986, that the Texas Board of Health has adopted the two regulations, identified during our program review, that are deemed to be matters of compa tibility.

Based on the above adoption and on your previous response letter of October 21, 1986, to the coments from our review of the State's program on August 29, 1986, we believe the Texas radiation control program is adequate to protect the public health and safety and is compatible with the NP.C's program for the regulation of similar materials.

I appreciate the courtesy and cooperation you and your staff have extended to us during this review period.

I am also enclosing a copy of this letter for placement in the State Public Document Room or to otherwise be made available for public review.

Sincerely, ORIGIN ^t SIONED 8 RO?iRT D. MARTIN Robert D. Martin Regional Administrator
