Dear'Dr. Palladino:

Following the Chernobyl-4 accident in the Soviet Union, the New York State Consumer Protection Board (CPB) retained MHB Technical Associates of San Jose, California to prepare a preliminary study concerning the implications of that accident for nuclear emergency planning in our State. A copy of MHB's report is enclosed.

As discussed in the report, Chernobyl demonstrates very clearly that nuclear power plant accidents are possible and that their consequences can be catastrophic. Although the American nuclear industry initially claimed that a Chernobyl-type accident could not happen here, recent reports indicate that Chernobyl 4 had safety systems that were analogous, at least in principle, to the safety features on some American commercial reactors, including Shoreham. We must redouble our efforts te lower the probability of nuclear accidents and strengthen our emergency response procedures.

To accomplish this objective, the CPB proposes that the Nuclear Regulatory Commission promptly initiate generic hearings to consider major changes in US emergency planning including:

expansion of the current 10 mile evacuation zone; development of measures for providing safe food and water supplies after an accident;

development of procedures for decontaminating land and water areas affected by a nuclear accident; and J

requirement of an evacuation plan for low power

, testing as well as other stages of operation for all nuclear plants. .

i We urge that these hearings be convened promptly so that 1

necessary changes in emergency planning.can be implemented as quickly as possible.
