IMPOSITION OF CIVIL PENALTIES - $50,000 By EN 86-27 dated April 28, 1986 the Commission was notified of the intent of IE to issue two Notices of Violation and Proposed Imposition of Civil Penalties in theamountof($250,000) to Texas Utilities Electric Company. The first action in the amount of $200,000 was based on the staff's review of allegations of improper construction practices at the Comanche Peak Steam Electric Station involving weaknesses in the implementation of quality programs during construction of Unit 1.
The second action in the amount of $50,000 was based on two issues involving the licensee's cable tray reinspection program and electrical penetration assemblies. The licensee responded on August 14, 1986 and paid the $200,000 civil penalties associated with the Quality Assurance Program. After careful consideration of the licensee's response and requested mitigation of the $50,000 civil penalties associated with the deficiencies identified in cable tray as-built inspection program, the staff has concluded that the violation occurred as stated in the Notice and that the civil penalties should be imposed.
Accordingly, an Order Imposing Civil Penalties in the amount of $50,000 has been issued today. Under the terms of the Order, the licensee may within 30 days of th,e date of the Order, pay the civil penalties or request a hearing.
