9 NOTICE OF VIOLATION University of New Mexico Docket No. 50 252 AGN 201M Licente No. R 102 i

During an NRC inspection conducted on September 1518,1997, violations of NRC requirements were identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violations are listed below:

1. The Code of Federal Regulations, Title 10, Part SS, Section 53(e), requires that operators licensed pursuant to that part, maintain proficiency by performing the functions of an operator or senior operator for a minimum of four hours per calendar quarter. If unable to meet the above, Section 53(f) of that Part requires that an operator must perform at least six hours under the instruction of a qualified individual performing the duties of the license p

before resuming licensed activities.

Contrary to this, the licensee permitted three licensed senior operators to perform licensed duties from October 1,1996 to December 31,1996 with them neither having performed a minimum of four hours in the preceding calendar quarter nor performing duties under instruction for a minimum of six hours before resuming licensed activities.

This is a Severity Level IV violation (Supplement 1).

- 2. Technical Specifications 3.2.b requires that the total scram withdrawal time for both safety rods and the coarse control rod be less than one second. Technical Specifications 4.2.a requires that control rod scram times be measured annually.

Contrary to '.his, the licensee had not rneasured the scram time for the applicable control

- rods in the past three years.

This is a Severity Level IV violation (Supplement 1).

3. The licensee's Physical Security Plan, Section 3.2.2.1 requires that unescorted access to the Nuclear Engineering Lab be restricted to those students who need access; are qualified as Radiation Supervisors; and at the beginning of each semester, have signed a written agreement to comply with security requirements.

Contrary to this, a graduate student had unescorted access to the nuclear engineering lab until his departure in February 1997 yet he neither qualified as a Radiation Supervisor nor had he signed a written security agreement since September 1994.

This is a Severity Level IV violation (Supplement Ill).

2-should be clearly marked as a 'Heply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will % taken to avoid further violations, and (4) the Cate when full compliance will be achieved. Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or a demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
