DPR-42 50-306 DPR-60 Withdrawal of Request for Exemption from 10 CFR Part 50, Appendix R, Section Ill.G.2, " Fire Protection of Safe Shutdown Capabilities" By letter dated August 14,1997 (supplemented by letter dated April 16,1998 and by Response to Request for Additional Information (RAl) dated November 2,1998),

Northern States Power Company (NSP) requested exemptions from the technical requirements of Section Ill.G.2 of Appendix R to Title 10 of the Code of Federal Reaulations, Part 50, to the extent that:

. Section Ill.G.2.c specifies the enclosure of cable and equipment and associated non-safety circuits of one redundant train in a fire barrier having a 1-hour rating, and

. Section Ill.G.2.f specifies separation of cables and equipment and associated non-safety circuits of redundant trains (in non-inerted containments) by a noncombustible radiant energy shield.

In lieu of enclosure of cables in a 1-hour barrier and in lieu of employing radiant energy shields in containment, NSP proposed to use fire-rated cables.

, September 7,1999 Page 2 would be acceptable, with the understanding that NSP would resubmit the exemption request upon completion of the response to the RAl.

By this letter NSP withdraws the August 14,1997, Request for Exemption from 10 CFR Part 50, Appendix R, Section Ill.G.2. NSP will review the RAI questions, but may not address them. For example, if we decide to wrap the affected cables with an approved 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br /> barrier instead of resubmitting the exemption request, we will not address the RAI questions, if NSP does decide to resubmit the request for exemption, the RAI questions will be addressed in the new submittal (in this case, a new exemption request i could be expected by April 29,2000.)

In this letter we have made no new Nuclear Regulatory Commission commitments.
