On September 15 - 19,1997, the U. S. Nuclear Regulatory Commission conducted an inspection of the QA program for shipping containers at the GE Nuclear Energy _
Production (NEP) facility in Wilmington, N. C. During the inspection, the audit team
- identified that Information Notice (IN) 97-47 titled " Inadequate Puncture Tests for Type -
/
~ B Packages Under 10CFR 71.73 (c)(3)" had been issued to advise recipients that the O
puncture test was not acceptable unless the steel bar on to which the container must fall N
had been mounted to an unyielding surface in a manner that prevented it from moving j
' during the test. The team further advised us that the IN applied to all packages required to meet Part 71.73, including type AF.

On October 1,1997,~ GE received by FAX a copy of NRC Bulletin (NRCB) 97-02,
' " Puncture Testing of Shipping Packages Under 10 CFR Part 71", dated September 23, 1997. In this bulletin, the NRC specified that the bulletin applied to all packages required to meet the requirements specified in 10 CFR 71.73(c)(3) The bulletin requested three -
actions on the part oflicensees and prescribed a schedule for completing each of the actions.

GE is the certificate owner of four NRC Certificates of Compliance. These include numbers 4909,4986,9009 and 9019.
GE plans to retain certificates 4986 and 9019. For these two packages, GE will be -
complying with the bulletin.
The packages represented by,;ertificates 4909 and 9009 are no longer used by GE nor does GE own any of then peckages. GE plans to contact registered users to determine if any of the registered users are interested in assuming licensee responsibility, if transfer 1
of ownership is desired, the NRC will be notified. If no one desires the license, GE will request that the package certificates be canceled. GE will complete these actions no later than December 22,1997. GE already knows that the test information that is available in our files is not sufficient to reach a conclusion that the puncture tests required by 10 CFR 71.73(c)(3) were conducted in accordance with IN 97-47 or NRCB 97-02.
