REQUEST FOR WITHHOLDING INFORMATION FRON PUBLIC DISCLOSURE (Millstone Nuclear Power Station, Units 1,2, & 3)
Dear Mr. Amerine:
In a letter dated September 10,1997, Northeast Nuclear Energy Company (NNECO) submitted to the NRC a " Preliminary Report on Alleged Retaliation in the Motor Operated Valve Program" (Report). In the letter it is requested that portions of the Report be withheld from public disclosure pursuant to 10 CFR 2.790. The September 10,1997 letter also contained an affidavit from you in support of NNECO's request.
NNECO stated that the Report should be considered exempt from mandetory public disclosure for the following reasons:

The information contained therein contains personnel information, the public disclosure of which would constitute a clearly unwarranted invasion of personal privacy.
2.
The circumstances of personnel actions taken against individuals is customarily--
treated in strict confidence by NNECO We have reviewed your letter in accordance with the requirements of 10 CFR 2.790,. We have also consulted with our Rogional Counsel on this matter. Section 2.790(u)(6) exempts from public disclosure "[plersonnel and medical filas and similar files, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy."
In deciding whether certain materials should be withheld from public disclosure, it is appropriate to segregate information which must be withheld from information which may be released.
We have carefully reviewed your request and the information contained in your report and have concluded that you have provided an insufficient basis for withholding the report in its entirety. However, you may submit additional information to support your withholding request or you may wish to consider identifying portions of the report which you consider 1

withholdable pursuant to section 2.790(a)(6) by " bracketing" the specific information to be witiincid on c clean copy of the report and also providing a nonproprietary version with the inforrnation redacted.
