NJPDES PERMIT NJ0025411 HOPE CREEK GENERATING STATION DOCKET NO. 50-354 Pursuant to the requirements of Appendix B " ENVIRONMENTAL PROTECTION PLAN (NONRADIOLOGICAL)" to Docket No. 50-354, enclosed is the modification'to the New. Jersey Pollutant Discharge Elimination System Permit NJ0025411 submitted for public notice on October 30, 1986. This modification is to authorize the closure of the Settling Pond utilized during construction to collect and settle metal cleaning wastes from the flushing and hydrotesting of piping systems. Special permit conditions include notification to the state of proper disposal of settled solids and closure in accordance with the plan submitted April, 1986.

A copy of the permit modification and the closure plan is enclosed.

Dear Mr. Sbissias:

Attached is a draft Major Modification to a New Jersey Pollutant Discharge Elimination System (NJPDES) permit that has been issued pursuant to N.J.A.C. 7:14A-1 et seg. This major modification is added to and made part of your Permit. It allows you to discharge to the Ground Waters of the State within the limits established in the attached conditions. This major modification is issued in accordance with the New Jersey Pollutant Discharge Elimination System Regulations, N.J.A.C. 7:14A-1 et seg. and you are required to comply with the terms and conditTons of this Permit. Unless specifically mentioned in this major modification, you are not relieved from any of the requirements of the previously issued permit.

Please be aware of the following provision of this permit:

Samples must be analyzed by a New Jersey Certified laboratory at the frequency and for the parameters specified in the permit.

Please be advised that failure to meet the conditions of the permit can result in the imposition of substantial administrative, civil, and criminal penalties.

The appearance of the public notice in the newspapers marks the commencement of the mandatory 30-day public comment period required by Section 8.1 of the NJPDES regulations. During this time frame, both the permittee and concerned citizens may offer comments regarding the terms and conditions of this draft permit major modification. All comments must be submitted witbin the appropriate time frame and in writing to:

f Notice is hereby given that the New Jersey Department of Environmental Protection, Division of Water Resources proposes to restrict and control the discharge of pollutants from Public Service Electric and Gas Company's Hope Creek Generating Station, which is in Lower Alloways Creek Township, Salem County, New Jersey.

PSE E G used a surface impoundment with a synthetic liner to collect and settle metal cleaning wastes from the flushing and hydrotesting of piping systems during construction of the Hope Creek Generating Station. Fresh water and domineralized water were circulated through the piping to remove mill scale and

, debris. Construction at the plant has been completed and the i

settling pond is no longer needed. The solids in the lagoon will be disposed of off-site, the liner will be removed, and the excavation will be filled.

i This notice is being given to inform the public that NJDEP has prepared a draft major modification NEW JERSEY POLLUTANT

, DISCHARGE ELIMINATION SYSTEM (NJPDES) action (NJPDES NO.

{ NJ0025411), in accordance with the provisions of the New Jersey i

" Water Pollution Control Act" (N.J.S.A. 58:10A-1 et seq.) and its implementing regulations (N.J.A.C. 7:14A-1 et sj@.).

This is an existing facility and implementation of the New Jersey i Pollutant Discharge Elimination System requirements are the i

enforcement mechanism by which existing pollutant discharges are brought into conformance and compliance with laws, regulations and standards. The pollution control requirements are those conditions necessary to restrict the discharge of pollutants and protect the public health and the environment.

The draft document prepared by NJDEP is based on the administrative record which is on file at the offices of the NJDEP, Division of Water Resources, located at 1474 Prospect Street in the Township of Ewing, Mercer County, New Jersey. It is available for inspection, by appointment, between 8:30 A.M.

and 4:00 P.M., Monday through Friday. Appointments for inspection may be scheduled by calling (609) 633-6620.

Interested persons may submit written comments on the draft to the Administrator, Water Quality Management, at the address cited above. All comments shall be submitted within 30 days of the date of this public notice. All persons, including the owner or operator, who believe that any condition of this draft document is inappropriate or that the Department's tentative decision to issue this draft document as a final agency action is inappropriate, must raise all reasonably ascertainable issues and submit all reasonably available arguments and factual grounds supporting their position, including all supporting material, by the close of the public comment period. All comments submitted by interested persons in response to this notice, within the time limit, will be considered by the NJDEP with respect to the requirements being applied to this facility. After the close of the public comment period, the Department .will make a final decision. The Department will respond to all significant and timely comments when a final decision is made. The owner or operator and each person who has submitted written comments will receive notice of NJDEP's final decision.

Any interested person may request in writing that NJDEP hold a nonadversarial public hearing on the draft document. This request shall state the nature of the issues to be raised in the proposed hearing and shall be submitted within 30 days of the date of this public notice to the Administrator, Water Quality Management at the address cited above. A public hearing will be conducted whenever the NJDEP determines that there is a significant degree of public interest in the permit decision. If a public hearing is held, the public comment period in this notice shall automatically be extended to the close of the public hearing.

1. The permittee shall notify the Department in writing of the disposal site of any sludge in the lagoon prior to removal.

This notification shall be sent to the attention of David Mooney at the following address:

2. Closure shall be conducted according to the plan submitted to the Department dated April, 1986. Upon completion of the closure, a signed and sealed statement from a licenced New Jersey Professional Engineer shall be submitted to the address in #1 above which states that closure was carried out according to the April, 1986 plan.
