Dear Mr. Bremberg:

This is in further response to your letter dated September 25, 1986, in which you requested, pursuant to the Freedom of Information Act (FOIA),18 categories of records related to the Uranium Mill Tailings Radiation Control Act of 1978.

At this time, we are able to provide the following additional information regarding the following categories of your request.

The NRC staff located no records regarding the following categories of your request.

There is no NRC policy on such criteria. The staff noted that you may wish to refer to Environmental Protection Agency standards found at 10 CFR Parts 20 and 40. You may also wish to correspond with the Radiation Control Program Directors for the Agreement States which regulate uranium milling and mill tailings.

The staff noted that information requested relative to the status of uranium mills, surety arrangements, decommissioning, etc., is contained in the official docket files in the PDR.

To assist you in the identification of these docket files, we are enclosing a list of uranium mills which gives the docket number, license number, and the operational status for each mill.

Docket files are also maintained at the NRC's Uranium Recovery Field Office, 730 Simms Street, Suite 100, Lakewood, Colorado.

In the event you wish to inspect the records at the Uranium Recovery Field Office, please telephone Mr. R. Dale Smith at (303) 236-2805 to arrange a mutually convenient date.

The NRC is withholding from disclosure a record which is subject to the following categories of your request.

The record identified on the enclosed Appendix A contains predecisional information on matters currently under review. The information is this record is being withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.

The persons responsible for the denial of this record are the undersigned and Mr. John G. David. Director, Office of Nuclear Material Safety and Safeguards.

The denial may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Executive Director for Operations, U. S. Nuclear Regulatory Comission Washington, D.C. 20555, and should clearly state on the envelope and in the letter that it is an

" Appeal from an Initial FOIA Decision."

The staff is continuing to search for and review additional records subject to your request. We will notify you upon completion of search and review activities.

With regard to your letter dated November 17, 1986, we wish to note with regard to your coments on category 10 that the F0IA provides access to records; the FOIA does not provide a forum to present arguments. Our response to category three is noted above.
