Dear Mr. Coalson:
This communication is in reference to the DOE letter of January 12, 1987 transmitting Modification A008 of Cooperative Agreement DE-FC04-82AL19487 between DOE and the Comonwealth of Pennsylvania. Giorgio Gnugnoli of my staff spoke with you on January 20, 1987 regarding NRC's concurrence with this modification. After our technical and legal staff review, it is apparent that some provisions, which were added, constitute revisions of a nonadministrative nature, such as those for restrictive covenants on Page 4.
As s_tipulated in
~the Memorandum of Understanding (MOU), NRC'should have concurrence involvement for these types of changes, since they are conditions to NRC concurrence for the disposition of the processing site.
By this letter NRC staff concurs with the changes, which appear to be consistent with UMTRCA Title I and with past correspondence from this office regarding the release of a portion of the processing site at Canonsburg.
It is not necessary to reissue this modification for NRC signature, but any future modifications of any cooperative agreement should be provided for NRC review and concurrence, unless the modifications merely address estimated cost sharing and simple DOE and State or Tribe administrative changes as stipulated in the MOU, Section 6.1.
