To Whom it May Concern:

This is in response to your Notice of Violation dated September 9,1997, regarding our use of a nuclear density gauge in July of this year at the Iowa Anny Ammunition Plant (IAAP) in Middletown, Iowa.

1) Reason for Violation: The IAAP is locally administered by the U.S. Anny Corps of Engineers. The Corps required us to submit their fann 385-11 along with copies of our nuclear materials license and personnel training certifications, in applying for pennission to use our nuclear density gauge on a construction project at the IAAP installation. The Corps of Engineers granted us pennission to use the gauge on this project with their letter dated July 10,1997. At that time, it was our understanding that this approval satisfied all pertinent government agencies.

2) Corrective Steps Taken and Results Achieved: As this was a very small project in tenns of our testing involvement, our finn had already completed our work before we were notified that we were in violation of NRC regulations. Ilowever, we have fully cooperated with the NRC Region ill Oflicers involved in giving them all infonnation and documentation pertaining to our commission of this violation.

3) Corrective Steps to be Taken to Avoid Further Violations: We have thoroughly discussed our obligation to follow correct NRC procedures with Region til personnel. We have received a copy of NRC regulations 10 CFR 150 and four copies of NRC Fonn 241. On any future projects requiring use of a nuclear gauge in areas of exclusive Federaljurisdiction within an Agreement State, we will submit the required copies of fonn 24I and our materials license to the NRC for prior approval.
