JANUARY STATUS REPORT /DG January 1987 UMTRAP STATUS REPORT Low-Level Waste and Uranium Recovery Projects Branch Division of Waste Management I. Site Summaries WM-42 CANONSBURG, PA (NMSS/WM)

The Canonsburg effort is nearing the end of Phase II, with the certification that remedial action is complete. NRC staff is presently reviewing the final certification package from DOE; and expects to provide a concurrence decision to DOE in the next month. The DOE is continuing baseline monitoring in order to establish action levels to be used during the surveillance and maintenance phase. As part of a court decision, NRC must notify, through the Department of Justice, a party of local plaintiffs of any action relating to or leading to NRC licensing of the Canonsburg site.

With respect to the Burrell Township Vicinity Property (VP), on June 25, 1986, NRC staff transmitted to DOE concerns regarding the adequacy of the present design and what course of action remains for the DOE to satisfy applicable standards. NRC staff visited the VP on November 4, 1986 to participate in a hydrology evaluation by DOE contractors. Furthermore, NRC staff reviewed a draft Surveillance and Maintenance Plan for the Burrell VP in support of future licensing, and provided comments to DOE on December 4, 1986.

WM-41 SALT LAKE CITY, UTAH (NMSS/WM)

Concurrences in the RAP and RAIP have been given and remedial action is in progress. Nearly all of the tailings and contaminated materials from the Vitro processing site have been moved to the Clive site. However, work at Clive has been halted for the winter months. To date, approximately 75% of the radon barrier has been placed and rock cover placement has begun on the sides of the pile. Review of RAP Modification No. I has been completed and concurrence given by letter dated November 14, 1986 (see issues summary for details). Related l revisions to the RAIP have been reviewed and comments provided to DOE by letter l dated December 9, 1986. Additionally, a preliminary design alternatives study l for disposal of additional vicinity property material i.n a separate cell adjacent to the tailings pile has been reviewed (see issues summary).

JANUARY STATUS REPORT /DG Representatives of the Central Valley Water Reclamation Facility (CVWRF), a vicinity property located on the site that includes the Salt Lake City processing site, met with NRC and DOE staff on January 8 and 14,1987, to discuss their need for imediate expansion construction onto the processing site. The need arises from a July 1,1988 Clean Water Act deadline for meeting NPDES effluent limits. DOE proposed that CVWRF proceed with its construction in the cleaned-up areas, that the State of Utah monitor excavated material and convey any high-concentration soil to the on-site staging area for shipment to Clive, and that DOE handle any additional costs as part of the overall remedial action. This proposal was acceptable to CVWRF with the provision that it be documented.

WM-58 SHIPROCK, NM (NMSS/WM) t Conditional concurrence in the RAP has been given, and construction is essentially complete. A closing ceremony was held by DOE and the Navajos on October 3, 1986. See the attached issues sumary for the status of the remaining RAP conditional concurrence issue on groundwater. Review of the Shiprock draft Surveillance and Maintenance Plan has been completed and comments sent to D0E.

NRC staff visited the site on December 11, 1986, and met with DOE / TAC staff to discuss further ground-water characterization plans necessary to resolve NRC/ Navajo concerns. The only other remaining work at the site will consist of compiling records for the completion report, and making any changes related to the monitoring program resulting from review of the Draft Surveillance and Maintenance Plan.

( WM-48 DURANGO, C0 (URF0)

The Final Remedial Action Plan (RAP), presenting a preferred alternative of relocation to Bodo Canyon, was reviewed and conditional concurrence along with final coments were transmitted to DOE by letter dated August 26, 1986.

Response to these coments was received on December 29, 1986, and is currently under review. The RAIP has been reviewed, and NRC coments have been incorporated into a revised document. The subcontract documents have been received and review coments were forwarded to DOE on May 15, 1986. On October 1, 1986, NRC staff concurred with DOE's decision to acquire the Durango site. A groundbreaking ceremony was held on December 8, 1986, but no construction activity is scheduled until the Spring of 1987.

WM-64 LAKEVIEW, OR (URF0)

NRC/URF0 has completed its review of the EA and RAP, and conditional concurrence was given in June 1986. Concurrence in the Remedial Action Inspection Plan (RAIP) has also been given. The preferred alternative consists of trucking the tailings and other contaminated site material to a site seven i

JANUARY STATUS REPORT /DG road miles'NW of its present location. A ground-breaking ceremony was held on July 9, 1986; R. D. Smith of URF0 attended. Excavation and liner construction

of both the encapsulation cell and the temporary runoff pond at the disposal site have been completed. The runoff pond was shown to have insufficient capacity, and an additional pond was contructed.

Approximately 160,000 cubic yards of tailings have been moved to the disposal site. NRC/URF0 staff inspected the construction activities at the site on September 8-9, 1986, and an inspection report was issued on September 17, 1986.

Issues are described in the attached summary. As of the second week of November, construction was halted for the winter. Project start-up is scheduled for May 1987.

WM-60 RIVERTON, WY (NMSS/WM)

The NRC staff has reviewed drafts of the NEPA documentation and the draft RAP.

The preferred alternative had been stabilization-in-place (SIP). However, consolidation of the Riverton tailings with an active mill site in the Gas

Hills of Wyoming, 45 miles away, has been suggested by the State of Wyoming.

The Wyoming governor and congressional delegation both requested that DOE have a plan by January 31, 1987 for removal of the Riverton tailings to the ANC i site. DOE is striving to devise such a plan by that date. DOE is also planning to prepare documentation (RAP and NEPA) addressing the excavation and

cleanup of the Riverton processing site and the transportation to the ANC facility. This should be available to NRC in April 1987, and DOE will at that time request an expedited review. As part of a generic review of the feasibility of disposal of UMTRAP wastes at connercial tailings sites, NRC prepared a legal response on June 16, 1986 for the possibility of disposal at the Gas Hills site.

URF0 is reviewing the active Gas Hills site's proposed license amendment to accept the Riverton tailings.

WM-61 GUNNISON, CO (NMSS/WM)

L Preliminary draft and draft EA's and RAP's presenting a preferred alternative of stabilization-on-site have been reviewed by NRC. In response to NRC staff review and local and state comments, DOE is revising the EA and RAP to consider additional alternate sites. Review of a revised EA/ RAP is scheduled to begin in April 1987.

WM-67 AMBROSIA LAKE, NM (URF0) y Initial EA and RAP reviews for Ambrosia Lake have been completed. A meeting between DOE and NRC/URF0 staff was held in late August 1986 to discuss comments and present preliminary design information. A test fill has been initiated at the Ambrosia Lake site to monitor magnitude and time-rate of settlement through instrumentation of saturated and unsaturated tailings areas.

JANUARY STATUS REPORT /DG WM-73 TUBA CITY, AZ (URFO)

Initial EA review for Tuba City has been completed. NRC staff review of the DRAP, which presented the preferred alternative of SIP, was completed on February 26, 1986, and coments were transmitted to DOE. Preliminary design documents and responses to NRC comments were received on August 25, 1986. NRC staff completed the preliminary design review and provided coments to DOE on October 16, 1986. The final RAP / design was received on November 24, 1986, and a response to the preliminary design coments was received on December 8, 1986. Coments on these documents were sent to DOE on January 28, 1987, and reflect that information gaps still remain to be filled.

WM-63 MEXICAN HAT, UT (URF0)

Initial EA review for Mexican Hat was completed in April and the draft RAP review was completed in May 1986.

WM-65 FALLS CITY, TX (NMSS/WM)

The NRC staff has received and reviewed TAC's data collection subcontracts. The preliminary final CADSAR was received on December 11, 1986. Coments from the staff's review were transmitted to DOE January 13, 1987. These coments addressed information needs specific to ground-water and geochemical aspects of the site, and apparent ambiguity regarding the acceptability of comingling. No significant flaws were identified based on the information provided.

WM-70 MONUMENT VALLEY, AZ (URF0) l The initial EA review was completed in April,1986. The DRAP was reviewed, l and coments were provided to DOE on June 6,1986. Because of significant flooding and erosion conditions as well as potential foundation problems at the site, NRC staff discouraged SIP and recomended that consideration be given to relocating the pile.

! WM-54 GRAND JUNCTION, C0 (URF0-EIS; WM-RAP) l The DEIS review began in May 1986, and coments were sent to DOE on July 30, 1986. The draft RAP was received on August 18. Draft coments were provided to DOE on September 18. A site visit was made during the week of l September 29. Final coments were sent on October 29, 1986. The PFEIS was i reviewed and the staff had no comments which precluded its issuance.

Preliminary design Phase I review is scheduled for February 1987.

WM-66 NATURITA, C0 (URF0)

The draft CADSAR was reviewed and coments were transmitted to DOE on July 24, 1986. The draft EA and RAP reviews are scheduled to begin in July 1987.

-JANUARY STATUS REPORT /DG Wi-68 GREEN RIVER, UT (NMSS/WM)

The draft CADSAR was reviewed and preliminary coments were telefaxed to DOE in early July 1986. Formal transmittal of comments took place on July 17, 1986.

A site visit by NRC staff was made during the week of September 29. The final CADSAR was reviewed and coments were sent to DOE on October 30, 1986. In these comments, the NRC staff has questioned DOE's decision to limit disposal options to SIP and SOS. Significant potential t'echnical problems were identified with respect to these disposal options.

WM-72 SPOOK, WY (NMSS/WM)

The draft CADSAR was received on November 3,1986, and coments were sent to DOE on November 26. Initial EA and RAP reviews are scheduled to begin in August i 1987. NRC staff visited the site and attended a meeting with representatives of DOE / TAC and the State of Wyoming on January 15, 1987. The meeting was held to discuss the coordinated clean-up of this site under UMTRCA and Wyoming's Abandoned Mine Lands Programs.

WM-62 RIFLE, C0 (NMSS/WM)

Initial EA review and draft RAP review are scheduled to begin in February 1987.

The draft CADSAR was received on July 10, 1986, comments were sent to DOE on August 8. Responses to the draft CADSAR coments and the preliminary finai CADSAR were received on December 22, 1986. Coments were sent to DOE on January 28, 1987.

Initial EA/ RAP review is scheduled to begin April 1987.

WM-43 LOWMAN, ID (NMSS/WM)

Draft CADSAR review is scheduled to begin in April 1987, and initial EA/ RAP review is scheduled to begin in April 1988.

this subject was issued in final form on March 21, 1986. j NRC Licensing Plan: WMLU has developed a licensing plan for UMTRAP sites which describes procedures for the licensing process. The plan will be transmitted to DOE and other interested parties shortly. Office Director approval to  ;

pursue a generic license rulemaking has been obtained. and documentation for EDO approval has been transmitted.

DOE Certification Plan: Further work on the DOE Certification Plan has been postponed until specifics of the Canonsburg site have been resolved. .Due to uncertainty regarding the EPA groundwater standards, DOE has postponed work on the generic plan. Through review of the site-specific reports, NRC will execute its concurrence role in the completion of remedial action at each site.

NRC Standard Review Plan ISRP)/ DOE Technical Approach Document (TAD): The NRC staff has reviewed DOE's 7AD, which describes technical approaches and design criteria to be used in preparation of remedial action plans. Comments were transmitted by letter dated February 26, 1986. A Final TAD dated May 1986, has been received and distributed to appropriate staff. Comments from DOE on NRC's SRP have been received and reviewed by approporiate technical staff. A response to comments together with proposed changes to the SRP was sent to DOE by letter dated May 1, 1986. Revision 1 of the SRP will be issued following completion of the erosion protection regulatory guide.

Erosion Protection Regulatory Guide: Regulatory Guide " Design of Long-Term Erosion Protection Covers for Reclamation of Uranium Mill Sites" is currently l under revision. This guide describes methods acceptable to the NRC staff for i

providing protection to prevent erosion of stabilized uranium mill tailings embankments. This revision to the guide incorporates information and design criteria developed under technical assistance contracts (long-term stability and riprap design using flumes) by Oak Ridge National Laboratory and Colorado State University. The revised guide will be completed by WM and submitted to RES by April 1, 1987.

l DOE Groundwater Protection Plan: The staff has reviewed DOE's Draft Interim UMTRA Project Water Protection Plan. Comments were transmitted on September 29, 1986. Along with the coments, the NRC staff position on UMTRAP groundwater reviews was conveyed as follows. On an interim basis, the staff will continue to base reviews on the EPA guidance in 40 CFR 192, Subpart C. However, pending conclusion of EPA's replacement.rulemaking, all NRC concurrences on remedial actions will be conditioned to require a further review against EPA's final groundwater protection requirements.

NRC-DOE Memorandum of Understanding: NRC staff has reviewed and revised the present UMTRA Memorandum of Understanding. The revised (MOU) has been reviewed by management and transmitted with comments to DOE on May 7,1986. Subsequently, DOE provided an updated proposed revision incorporating seme of NRC's 4

recommendations and reflecting the revised document preparation procedures.

1 NMSS received this version on July 14, 1986, and has coordinated the review i with URF0. NRC and DOE staff have discussed this revision and further NRC concerns by telecon on September 10, 1986. Meetings between DOE and NRC staffs have been held to resolve these concerns. A final revision will be sent to NRC for approval.

Disposal of Title I Waste at Title II Sites: DOE requested NRC's formal position on disposal of UMTRAP wastes at active uranium mills. OGC(formerly ELD) reviewed the request in light of flexibility in VMTRCA to follow this type of disposal strategy. NRC transmitted the conclusions of the OGC analysis to DOE on June 16, 1986. The State of Wyoming also requested similar information and has been notified of the NRC response. DOE is evaluating the feasibility of this course of action in light of discussions with NRC and other interested parties. NRC staff briefed Congressional staff on December 8,1986 with regard to the flexibility of co-disposal.

DOE Generic Study DOE / TAC is proceeding with a special study to predict the long-term soil noisture of the radon cover, and the impacts on downward flux of water through the tailings and radon exhalation. Three technical experts have been contracted to provice support.and guidance for developing the methodology and ccmputer program used in the calculations. The first technical meeting, held on December 15 and 16 and attended by the technical experts and a representative from the State of Colorado, yielded useful criticism and suggestions for improving the accuracy of the program, now called S0ILMOIST.

l WM and URF0 staff are presently reviewing the technical merits of the project and will attend a final technical meeting to be held in mid-February. The project is tentatively scheduled to run through February,1987.
