FEMA'S RESPONSE TO SUFFOLK COUNTY'S MOTION FOR ORDER CCMPELLING FEMA TO ANSWER INTERROGATORIES FEMA hereby files its response to Suffolk County's Motion for Order Compelling FEMA to Answer Interrogatories served on FEMA on Novemcer 12, 1986 at 5:15 P.M.

The representations by Counsel for Suffolk appear to adequately represent the basis for FEMA's response or non-response to the First Interrogatories served on October 15, 1986. Accordingly, FEMA respectfully requests that the Board ~ deny the Motion for Order Compelling FEMA to answer the First Interrogatories at this time. Once reconsideration of the Board's Octcber 3, 1986, order is granted or denied, FEMA will in good faith rescond to all discovery requests, which FEMA fully recognizes are continuing, for supplementation FEMA also beleves that the Board should instruct all parties that Motions to Compel or Protective Order requests should be reserved for only the most compelling circumstances, and as evidenced by the 17 page Motion to which this response refers, snould only be filed after conolete review of all discovery activities and agreements bet.een anc among the various Counsel..

FEMA believes that Footnote 5 on page 1 of the Ncvemoer ;0:n m icn raises an issue of scme imoortance to further concuct of this croces;ing.

FEMA after a full analysis of the Mot on recuests that ne Board treat tne i

Motion to Compel and in particular the discussion witn rescect t FEMA's status as a Petition for Rulemakeing under 10 CFR 2.302 anc forward it to ne procer office within NRC for whatever action is deemed acprocriate.

The Board's time should not be wastea with furtner consideration of anat may oe a generic issue. Counsel for FEMA does represent to the Board that he nas ceen unable through diligent research to determine whether any definitive ruling cn FEMA's status before ASL85 exists but reauests through this served resconse that if any sucn ruling does exist anc is kno n to the numerous at ceneys for NRC, applicant. and intervenors, that such ruling ce served on FEMA and tnis Soard within 10 days.

Respectfully submitted.
