filing a Notice of Appeal from the Licensing Board Memorandum and Order of the Atomic Safety and Licensing Board entered October 30, 1986, together with a brief in support of such appeal.

While the Order appealed from does not open discovery l

and therefore arguably can result in no immediate and irrevocable harm to the applicants, out of an abundance of 4

caution, and in order to preclude any argument that there has been a waiver of the right to seek a stay of such discovery as might be ordered by the Licensing Board herein, the applicants, pursuant to 10 CFR $ 2.788(a), hereby move l

the Appeal Board to enter an order prohibiting the commencement of any discovery or other activity pursuant to the Order of the Atomic Safety and Licensing Board appealed from.

To make the necessary showing of likelihood of success on the merits, the applicants rely on their brief on appeal filed herewith.

The applicants will be irreparably injured if a great deal of time and expense has to be devoted to discovery which proves unnecessary in the event the applicants' position is sustained on appeal.

i No harm of permanent nature will be incurred by the consolidated intervenors in the event discovery is delayed until resolution of this appeal.

The public interest is not served by the expenditure of time and money by a public utility in discovery which proves unnecessary.
