Dear Sir:

This is an appeal, pursuant to subsection (a) (6) of the Freedom of Information Act as amended (5 U.S.C. 552), of the actual denial of the Commission to release documents requested on January 14, 1986 by the Government Accountability Project regarding SECY 85-404. 3 By letter dated April 23, 1986 Mr. Donnie Grimsley, Director of the Division of Rules and Records advised us of 2 documents being released to the PDR, 1 document being withheld in part and 13 documents being withheld in their entirety pursuant to FOIA Exemption 5, because they contain the predecisional analyses, opinions and recommendations of the Commissioners, the release of which would tend to inhibit the open and frank exchange of ideas essential to the deliberative process.

For reasons stated in our April 11, 1986 appeal letter, we believe we are entitled to the release of these documents. At a minimum there chould be reasonably segregable portions of the I documents which are releasable.

We expect your response to this appeal within 20 working days of your receipt so that we can determine whether to pursue I

this matter further in the courts.

Dear Ms. Garde:

This is in further re::ponse to your letter dated January 14, 1986, in which you requested, pursuant to the Freedom of Information Act (FOIA), copies of ,

documents generated in connection with SECY-85-404, " Unauthorized Disclost res of Sensitive Infonnation - Availability of Administrative Sanctions Against NRC Employees and Special Government Employees," dated December 23, 1985.

The documents identified on enclosed Appendix B are being released at Comissioner Asselstine's discretion and are being placed in the NRC Public Document Room (PDR) located at 1717 H Street, NW, Washington, DC 20555, in file folder F01A-86-40 in your name.

Portions of the document identified on enclosed Appendix C, and the documents identified on enclosed Appendix D contain the predecisional analyses, opinions, and recomendations of the Comissioners, and between the Comissioners and their staffs, concerning proposed rulemaking. Because the information reflects the predecisional process among the Commissioners, and between the Commissioners and the staff, the information is exempt from mandatory disclosure pursuant to Exemption 5 of the F0IA, 5 U.S.C. 552(b)(5), and the Commission's regulations at 10 CFR 9.5(a)(5). Release of the information would tend to inhibit the open and frank exchange of ideas essential to the deliberative process. The released portions of the document on Appendix C are being placed in the PDR in file folder F01A-86-40 in your name. The documents on Appendix D contain no reasonably segregable factual portions and are being withheld in their entirety.

Pursuant to 10 CFR 9.15 of the Comission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for this denial is Mr. John C. Hoyle, Assistant Secretary of the .

Commission.
