MINUTES OF THE CRGR MEETING NUMBER 326 The Committee to Review Generic Requirements (CRGR) met on Tuesday, August 11,1998, from 9:00 a.m. to 11:00 a.m. Joseph A. Murphy presided as Acting Chairman. Attachment 1 contains a list of attendees.
R. L. Spessard (NRR), and S. Aggarwal (RES) presented for CRGR review and endorsement the final amendments to Paragraph (h) of 10 CFR 50.55a," Codes and Standards," requiring future plants to conform to IEEE Std. 603-1991," Criteria for Safety Systems for Nuclear Ppwer Generating Station." The latter standard supersedes the now-withdrawn IEEE Std. 279-1971,
" Criteria for Protection Systems for Nuclear Power Generating Station," which is in the licensing basis of many operating plants. The provisions of the final rule would require the post-19993 licensed plants to conform to the requirements of IEEE 603-1991 (including correction, dated January 1995); its use is voluntary for the rest. This was the first time CRGR reviewed this rule.
The Committee had deferred a formal review at the initial direct final rulemaking stage and again when the rule was re-issued for public comments as a proposed rule, after the direct final rule was withdrawn in response to adverse public comments. CRGR review of this rulemaking at earlier stages was deferred with the expectation that the staff will submit for CRGR review the draft final rule after resolution of public comments. Furthermore, this rulemaking was consistent with the Committee's previous recommendation (when it reviewed the Regulatory Guides 1.153, 1.168 through 1.173, and the Standard Review Plan, Chapter 7 Update," Instrumentation &
Controls") that the staff should initiate necessary steps to ensure consistency of NRC regulations with the current NRC-endorsed industry standards applicable to instrumentation and controls. At this meeting, no presentation material was used by the staff.
At this meeting, the CRGR made the following comments and recommendations:

Making IEEE std. 603-1991 as part of the regulation is not the most efficient use of the staff resources, as it would necessitate a rule amendment to incorporate future updates of this IEEE standard or NRC endorsement of alternate standard (s). In the Committee's view, the preferred approach would be to include in the rule performance criteria for a digital system, and to include in a companion regulatory guide the IEEE std. 603 as an acceptable standard for designing one. However, given the schedule for this rulemaking effort, the Committee deferred the final decision in this respect to the staff; (2)

The proposed wording in 50.55(a)(h)(2) should be made consistent with respect to the protection system requirements and changes to protection systems; and
-(4)
The proposed wording in 50.55(a)(h)(3) should be modified because, in addition to combined licenses, it includes.a reference to construction permits and operating licenses; the future plants will be securing combined licenses.
The staff incorporated the CRGR comments and recommendations and revised the rule language, which was submitted for the Committee's endorsement on October 21,1998. On November 3,1998, the CRGR endorsement was relayed to the staff. (Attachment 2).

CRGR ENDORSEMENT OF FINAL RULE AMENDING PARAGRAPH (h) 10 CFR 50.55a On August 11,1998, at its 326th meeting, the Committee to Review Generic Requirements (CRGR) reviewed the final rule to amend Paragraph (h) of 10 CFR 50.55a, " Codes and Standards." Following the CRGR meeting, via a couple of e-mail exchanges on August 20,.
1998, between you, Satish Aggarwal of RES, and myself, the following agreement was reached on CRGR comments and recommendations:
- 1. The Committee noted that a regulatory guide would have been a better vehicle to accomplish the purpose; however, recognizing the schedule impact, the Committee did not press this point.
- 2. On Page 4 of the Federal Register Notice (FRN), delete the words, " June 12,1998."
- 3. In the proposed rule language, in Paragraph (h)(1), delete the sentence "...A notice of any changes made to the material incorporated by reference will be published in the Federal Register..." as it imposos an unending burden on the staff.
- 4. Also in the proposed rule language, in Paragraph (h)(2), in the sentence "...For nuclear power plants with construction permits issued before January 1,1971, any changes to protection systems...", delete the words,"any changes".
- 5. Additionally, in the proposed rule language, delete any references to " operating licenses" as
. the future plants will be issued a combined license.
On August 20,1998, Mr. Agganval sent a revised FRN, which addressed all except item 4, as noted above. He acknowledged this ineM!crtent omission and assured necessary changes to the FRN. However, we received no further communication and no formal CRGR endorsem'ent was sent. On October 21; 1998, Mr. Aggarwal asked for a formal CRGR endorsement, and at my request, also assured that for completeness of the CRGR records he would send me the final version of the FRN.
Based on Mr. Agganval's assurance of forwarding an FRN which would have incorporated all the aforementioned changes, and your previous concurrence via e-mail to me, this communication formally relays CRGR endorsement for issuance of the final rule to amend Paragraph (h) of 10 CFR 50.55a.
